The tax office will increase its civil claim against the fugitive leader of Agape Ministries, Rocco Leo.

It is alleged in court documents Leo failed to pay $1.7 million in income tax for the 2010 financial year, his associate Joseph Veneziano failed to pay $700,000 and Agape Ministries owed the Commonwealth $1.6 million.

the issues of whether Agape Ministries was a religious institution

Lawyers for the Australian Taxation Office told the Adelaide District Court a tax audit from 2001 to 2010 has been completed and the plaintiff will amend its claim to add more costs.

The amount was not revealed in open court.

Lawyer for the defendants, Sam Doyle, said he would be seeking a meeting with the tax office to try to resolve the issues of whether Agape Ministries was a religious institution and whether it was obliged to pay tax.

The case returns to court in August.
